Terms and Conditions of the Max Control Championship competition

1. Definitions

In these Terms and Conditions the following words shall have the following meanings:

  • “Activity” - all Max Control activities run by the Organisers
  • “Entrant” - the individuals registered on the Max Control website to take part in the activities
  • “Organisers” - The Promoter, its partner organisations or other businesses running the Activities
  • “Terms and Conditions” - the competition rules set out in this document
  • “The Promoter” - Somerset Road Safety Partnership.

Max Control is a competition promoted by the Somerset Road Safety Partnership (“The Promoter”). It encourages young drivers to improve and prove their roadcraft and driving skills and offers the chance to win prizes, including a brand new car with insurance. Max Control is free to enter, although some of the Activities that offer credits to Entrants have a fee attached to them.

The Promoter’s decision is final and binding in all matters and no correspondence will be entered into.

2. Prizes

The first prize is a brand new Renault Clio Extreme 1.2 16v 75 3 door (colour black), with 12 months fully comprehensive insurance.

All other prizes will be added to the website as they are confirmed.

The first prize and all other prizes are non-transferrable.  No cash or other alternatives are available.  The Promoter reserves the right to substitute a prize for another prize of equal or general value at any time.

3. Conditions of entry

To be eligible to take part in the competition, Entrants must:

  • be resident in the county of Somerset for the duration of the competition up to August 1st 2010
  • be under 25 years of age on August 1st 2010
  • hold a valid car driver’s licence
  • be in good health and free from any medical illness which could affect or impair their ability to participate in an Activity
  • be contactable via telephone and/or email; and
  • not be an employee or an immediate family member of an employee of the Somerset Road Safety Partnership (defined as parents, children, siblings, spouses and partners), or anyone professionally connected to the competition
  • not have any convictions for drink driving, either before or during the competition (any convictions need to be declared by the entrant during the competition. All entrants will be disqualified if found to have a drink driving conviction)

Entrants agree the following:

(a) To participate in any associated publicity or promotional activity for Max Control, should they be required to do so by the Organisers

(b) To be bound by these Terms and Conditions

(c) The Promoter reserves the right at its sole discretion to disqualify any Entrant found to be tampering with the operation of the competition or website, or to be acting in any manner deemed by the Promoter to be a breach of the Terms and Conditions

(d) The Promoter reserves the right to disqualify any Entrant who it believes has supplied false information, or is not eligible to be an Entrant

(e) The Promoter reserves the right not to award a prize if there is any suspicion of fraud

4. How to take part

Entrants should sign up for the competition via the Max Control website, at www.maxcontrol.org.uk. All Entrants who register via the Max Control website agree to be bound by the Website Terms of Use.  Any Entrants who wish to take part but do not have access to the website should write to The Promoter at the address listed at the end of this document.

The final date for earning credits by completing any of the listed Activities is June 11th 2010 (the closing date).

Once an Entrant has been checked and accepted in the competition, they will receive an email informing them that their account is now live. After this point they will be able to register their interest for activities. After each activity they will be awarded a number of credits, these will be added to their total and viewable on the “My Credits” page of the website.

5. Activities

Registered Entrants can apply for Activities from October 1st 2009.

Entrants earn credits by taking part in various Activities that are published on the website (Activities are subject to change and subject to availability).

Entrants must register interest of each activity through the website. Activities will then be coordinated and registered. Entrants will be invited to attend or participate in the appropriate way.

Some of the Activities may require Entrants to make arrangements with the organisers directly and send proof of completion to the Promoter. Instructions will be included on the website for each Activity that requires this.

Activities are subject to availability. Entrants will be notified if an Activity is fully booked when they register interest. The Entrant will no longer be able to take part in that Activity and should register their interest for an alternative Activity.

Each Activity is allocated a range of credits (dependant on a number of factors including difficulty level, the time commitment required and the ability of that Activity to increase driving skills). Credits are awarded once the contestant has taken part in the activity. Judges at Somerset Road Safety Partnership and partner organisations will allocate the credits and the judges’ decisions are final.

Many of the Activities do not require the payment of a fee to participate. Activities that have a fee do not have to be completed in order to enter the competition. Fees are declared in advance for each Activity wherever possible.  Payment for Activities is non-refundable.

All Activities must be completed by June 11th 2010.

6. Participation in Activities

Entrants agree the following:

(a) All Activities being run by the Organisers will be subject to separate terms and conditions relating to the careful and safe participation in the Activity and the use of the equipment, vehicle and premises. Entrants agree to be bound by the terms and conditions and agree to follow all instructions given by the Organisers at all times

(b) Prior to the start of each Activity all Entrants will be required to produce a valid driving licence

(c) If an Activity requires Entrants to use their own vehicle it must be roadworthy with a valid MOT test certificate and the Entrant must have car insurance. Prior to the start of the Activity all Entrants will be required to produce the MOT test certificate and car insurance policy document

(d) The Organisers may refuse to allow an Entrant to participate or continue to participate if, in their reasonable opinion, the Entrant appears unfit to drive due to the influence of alcohol or drugs or the Entrant disregards any instructions or is in any way causing a nuisance, damage, disturbance or inconvenience to them or other Entrants. The Promoter reserves the right to disqualify the Entrant from the competition in these circumstances

(e) The Organisers may at any time suspend or terminate an Activity if it considers there is a risk to the health and safety of the Entrants

(f) If a fee is payable for an Activity Entrants will not be allowed to participate unless payment has been received in full

(g) Entrants participate in Activities at their own risk

7. Grand Final

On the closing date (June 11th 2010), the 10 Entrants with the highest points totals will go forward to the Grand Final.  The Entrants will be notified via email and/or telephone within 14 days of the Grand Final.

The names and towns of the 10 Entrants will be published on the website for a minimum period of three months after the closing date.

Ten finalists will take part in the Grand Final on Sunday August 1st 2010 (location to be confirmed).

Grand Finalists will be required to take part in a range of assessments, including a practical driving test. These assessments will be judged by a qualified panel including representatives from the IAM and ROSPA and an independent judge. The decisions made by the judges are final and no correspondence will be entered into.

If a qualifying Entrant is unable take part in the Grand Final, then the next highest scoring Entrant from the competition will be notified and invited to take part in the Grand Final.

The winner will be declared at the end of the Grand Final. The winner’s name will be published on the website on Monday August 2nd 2010.

The Promoter’s decision is final and binding in all matters and no correspondence will be entered into.

8. Limitations of liability

Neither the Promoter or its partner organisations has any responsibility or liability for:

  • damage, loss or injury suffered by any Entrant in connection with the competition and the Activities save for those arising from the negligence of the Promoter or its partner organisations
  • any incorrect or inaccurate code entry, or for any faulty or failed electronic data transmissions
  • technical malfunction, communications line failure, regardless of cause, with regard to any equipment, systems, networks, lines, satellites, servers, computers or providers utilised in any aspect of this competition
  • inaccessibility or unavailability of the internet or the website or any combination thereof
  • any injury, loss or damage to winning Entrants upon delivery and/or use of their prize.

The Promoter, its partner organisations and agents cannot be held liable for system failures on the website or associated systems. Neither can they be held responsible for the failure to fulfil the obligations of any third parties involved in this competition, although they will always endeavour to minimise the effect to the Entrant of any such failure.
